Piano Rental Terms and Conditions (Acoustic and digital
pianos)
1. PHYSICAL
CONDITION OF INSTRUMENT
It is the responsibility
of the renter to look after the piano, and to make sure the condition of the piano is the
same as it exists at the time of delivery, except for wear and tear.
The renter is responsible for piano tuning (applicable to acoustic pianos only) at least twice a year after
the piano has been delivered to the renter. Pianos may only be tuned or serviced by Music Talents Ltd.,
and may not be tuned or serviced by any other company or individual (except with the consent of Music Talents
Ltd).
2. DELIVERY
REQUIREMENTS
The renter must clear and
prepare the delivery location and the means of access to receive delivery of the piano. Delivery involving
extraordinary access or conditions (for example, over railways, stairways, lofts, marble or hardwood floors,
etc.) shall be made at the renter’s sole risk and expense. Furniture and other items removed by Music Talents
Ltd. shall be moved at the renter’s risk. Music Talents Ltd shall have no liability for any delays in
delivery.
Notwithstanding anything to the contrary contained herein, Music Talents Ltd. reserves the right to cancel this
rental contract if Music Talents Ltd. determines that the intended location of the piano in the residence or
the means of access to the delivery location is unacceptable to Music Talents Ltd, as it sole discretion. If Music
Talents Ltd has not been informed of any stairs or steps, then Music Talents Ltd. have the right to charge an
additional amount to cover this.
3. USE OF PIANO
The renter agrees that
acoustic pianos will be used only at the residence set forth on the front of this rental contract, and only for
the purpose for which it was intended.
The renter may not sublease or improperly use the piano. The renter may not move the piano from its original
location. If the renter moves home and desires the acoustic piano to be moved, only Music Talents Ltd. shall move
the acoustic piano, which shall be at the expense of the renter.
4. RESPONSIBILITY
FOR PIANO
The renter acknowledges
that from the time the piano is delivered until it is returned, the renter is responsible for the piano.
The renter agrees to exercise due and proper care in re-use and maintenance of the piano. If the piano is
lost, stolen, vandalized, destroyed or damaged prior to being returned to Music Talents Ltd., regardless of
fault, the renter is responsible for all damages, including, but not limited to, the costs to replace or repair
the piano.
The renter agrees to
notify Music Talents Ltd. immediately if the piano does not function properly. No refund or allowances will
be made by Music Talents Ltd unless Music Talents Ltd. receives such notification and has had an opportunity to
inspect the piano.
5.
PIANO FAILURE
The renter agrees to
notify Music Talents Ltd. immediately if the piano becomes inoperable for any reason. It is Music Talents
Ltd. discretion to make the piano operable within a reasonable time, or provide the renter with a
similar piano if available, or adjust the piano rental rate.
The provisions of this
paragraph do not relieve the renter from the obligations imposed by the other paragraphs, including, but not
limited to, paragraphs 3, 5 and 6. In all events, Music Talents Ltd. shall not be responsible for any loss or
damage including, but not limited to, consequential damage resulting from failure or defect of the
piano.
6. RETURN OF THE PIANO
One month’s notice of
termination must be provided to Music Talents Ltd. if the contract is terminated before the minimum rental term
has expired, the renter is liable for payment of the remaining rental term.
Upon termination of this
rental contract for any reason whatsoever, the renter agrees to cooperate in the return of the piano during
Music Talents Ltd. normal delivery and pick up days, within the hours of 08:00 to 17:00 Monday to Sunday without
specified times. The renter acknowledges that if inaccurate access information is given it could delay
collection and may incur additional charges. Please note: if the piano is collected from the same place it was
delivered then the collection charge will be the same as the delivery charge. Digital pianos can be brought back
in person if you prefer.
7. CHARGES AND
PAYMENT
The renter is responsible
for rental charges and all sales and use taxes thereon from the time the piano is delivered until it is
returned to Music Talents Ltd. Pianos rented for part of a billing month shall be charged for at daily
rates.
8. RENTAL
ONLY
This rental contract is
not a sales contract. However, should the renter wish to purchase their piano this may be arranged at any
time. If purchased any time within the first 6 months then the renter can deduct 100% of their rental
payments to be deducted from the price noted at the time of commencement of the rental. Upon the 6th month
of rental, at this point the renter may allow a discount equal to 6 monthly rental contributions. After a period
of 12 months the discount is equal to 9 months rental contributions for digital pianos and 12 months discount
for acoustic pianos, and shall remain so for the duration of the rental thereafter.
The piano is and
shall remain the property of Music Talents Ltd., until such a time as the piano is purchased in full as per
the terms of this contract. The renter shall not remove any identification tags which are attached to the inside
of the piano. The renter has only the right to use the piano so long as this rental contract has not
terminated and the renter is not in default hereunder.
9. PROHIBITION OF TRANSFER OF RENTER’S INTEREST
The renter shall not
sublease, rent, assign, or grant a security interest in, or otherwise transfer the piano to another
party.
10.
INSPECTION
The renter agrees to
allow Music Talents Ltd. to inspect the piano at any reasonable time.
11. LATE
CHARGE
If the renter fails to
make a monthly payment in full within ten (14) days after it is due, the renter shall pay a late charge in the
amount of five percent (5%) of the part of the payment that is late.
12.
DEFAULT
If the renter is in
default of any of the terms and conditions of this rental contract, Music Talents Ltd., in order to enforce its
ownership rights in the piano and to protect its interest in this rental contract, may take possession of
the piano without judicial process and to do so, Music Talents Ltd. or its representatives, may enter the
renter’s property and the renter hereby waives any right or action against Music Talents Ltd. for such entry and
retaking.
In addition, the renter
acknowledges that the failure to return, or the conversion or concealment of the piano is prohibited and
such action may constitute a crime. In such event Music Talents Ltd., in addition to any other action it is
entitled to take, may notify all authorities and take such other action, including, but not limited to, the
filing of criminal complaints.
In the event of default
by the renter, the renter agrees to pay Music Talents Ltd. legal fees, collection fees, court costs and any
other costs and expenses incurred by Music Talents Ltd. in collecting any amounts due under this rental contract
including, but not limited to, all costs associated with the retaking of the piano or otherwise enforcing
the terms of this rental contract.
13. MISCELLANEOUS PROVISIONS
The renter warrants the
truth and accuracy of all information contained herein and in all applications given to Music Talents Ltd. by
the renter. This rental contract shall be governed by, and construed and interpreted in accordance with the laws
of the United Kingdom. This rental contract contains the entire agreement of the parties hereto with respect to
the rental of the piano, and no prior or contemporaneous representations, inducements, promises, or
agreements, oral or otherwise, between the parties not embodied herein shall be or any force or
effect.
This rental contract
shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs,
executors, personal representatives, successors and assigns. No amendment to this rental contract shall be
binding any of the parties hereto unless such amendment is in writing and such amendment is executed by the
parties hereto.
Time is of the essence of
this rental contract, and every provision herein. If the renter is composed of more than one person, the
choices, designations, and other decisions of one shall bind all of the others, and all persons composing the
renter shall be jointly and severally liable for all obligations of the renter herein. parties hereto. Time is
